On Wednesday, Oregon’s Supreme Court refused to approve Initiative Petition 43 - a state ballot proposal for an assault weapon and high-capacity magazine ban - due to the initiative’s repeated use of vague and misleading language and outright false claims to describe the proposed law to voters. Furthermore, the court directed Oregon’s attorney general to revise the language of the initiative to comply with state laws requiring Oregonians to be accurately informed about the law’s key provisions at the ballot box.

However, even if the necessary revisions were made to the gun control initiative’s language, supporters of the measure would need to collect 88,184 signatures by July 6thto get it on this year’s ballot. Furthermore, the collection of those signatures could not legally start until Attorney General Ellen Rosenblum made the revisions to the ballot language required by the court. Given these legal roadblocks, multiple local news sources were not optimistic about the initiative’s chances for success.

Unsurprisingly then, in response to the Supreme Court’s decision, the Portland religious leaders who are the main backers of Initiative Petition 43 announced on Thursday that they would not continue their efforts to get the gun control proposal on November’s ballot. According to The Oregonian:

The California Supreme Court on Thursday threw out a lawsuit brought about by the National Shooting Sports Foundation (NSSF) which sought to pause enforcement of part of a law that required new semi-automatic firearms stamp identifying information on its casings.

According to the NSSF, the technology does not currently exist, making it impossible for gun manufacturers to comply with the law.

"Neither the text nor the purpose of the [Unsafe Handgun] Act contemplates that a showing of impossibility can excuse compliance with the statutory requirement once the statute goes into effect," the court said in its decision.

Bill H4670 enables the police, a family or household member, including roommates, relatives or significant others, to remove firearms, firearm identification cards and ammunition from any individual deemed to be a danger to oneself or others.

Seattle passed a law Monday requiring gun owners to store firearms unloaded and in a secured container.

CB119266 was passed unanimously by the Seattle City Council and makes it a civil infraction to keep firearms unlocked or loaded while not under control of the owner, imposing a fine of up to $500.

Violating the ordinance can result in even higher penalties, up to $1,000, if the firearm is accessible to a minor or an “at-risk” person. It can incur penalties of up to $10,000 if a minor, “at-risk” person or prohibited possessor obtains the firearm and uses it to harm oneself or another. In the complaint, attorneys argued Cabela’s, and its parent company, Bass Pro Group LLC, violated state law by selling a
“black powder gun” — a replica of an antique firearm made from modern materials — to Paul R. Claren, the Orrville man who killed Galliher using the gun in August 2016.



The lawsuit alleges that Claren purchased an 1858 Army .44-caliber black powder revolver from Cabela’s over the phone in December 2014. In July 2016, Cabela’s also sold Claren a black powder loading kit that he used to load the revolver, the lawsuit states.

Galliher’s family, namely his mother Gerri and sister Alissa, are seeking “damages and other proper relief resulting from Cabela’s and/or Bass Pro Group’s illegal, negligent, and reckless sale of a firearm to Paul Claren,” according to the complaint. The lawsuit does not specify how much money the plaintiffs are seeking, but the compensatory damages requested will exceed $25,000, according to the complaint. The family is also seeking punitive damages against Claren and the companies.

Bass Pro Group, LLC did not return requests for comment.
As a police officer and chief investigator for the Stark County Coroner’s Office explained, federal law did not require Claren to undergo a background check to purchase the replica of the antique firearm. However, Ohio’s state law did require a background check.

They're saying he went to his car to get the gun, but how he managed to then get the gun pass the magic door stickers is a complete mystery. He must of have used one of those NRA counter spells. Maybe they need to pass a stronger worded law making it triple illegal.
