School carpool

Post by Geno » Fri Aug 15, 2014 3:36 pm

With school beginning, I am wondering if it is legal to drive through a public school carpool line with a firearm in the car? I have always viewed my auto as an extension of my home. Thanks in advance for feedback. Geno

When I do drop offs/pick ups I always carry. I understand this is legal after the incident at Doss last year.

The way I understand it, as long as it stays in the car it is legal.

With a CCDW? Legal (as long as the permit is from the state where the school is located)

Without a CCDW? Illegal, as it's a violation of the federal Gun Free Schools Act.

*But* to the best of my knowledge no one has ever been charged with a GFSA violation without first being charged with something else.

While I think technically it is a violation of the GFSA without as permit I read a legal opinion piece some time back about how this is dealt with in states that do not require permits.

I would say that it is likely you would not be charged in Kentucky even without a permit as long as you are not brandishing. Even without a permit you can legally conceal in the car.

Not sure I would want to be the test case in federal court, but it is not like you see prosecutions of the GFSA on a daily basis or DHS checkpoints in school parking lots each morning.
