In a retail store yes W8 is about all you'll find, but order off some place like Newegg.com and buying a NIB win 7 notebook is no problem. I'm typing on a brand new Win 7 notebook right now. I actually had gotten a VGA card that was DOA. They replaced it with no questions asked.
